1. Conditions

Pharmaserv SA sells pharmaceutical raw materials (API), substances, and chemicals listed in the catalog exclusively to businesses, under the terms and conditions stipulated below.

2. Contract Term

The contract is concluded upon the order placed between Pharmaserv SA and the client. Orders can be made by phone, in writing, or online. Pharmaserv confirms the order to the client via fax, email, or postal mail. Goods are delivered with the manufacturer’s certificate of analysis.

3. Offers

All offers are non-binding. Technical data and prices are subject to change. Technical information is provided by the manufacturer; any description errors or inaccuracies are solely the responsibility of the manufacturer.

The delivery time indicated is an estimate and is not guaranteed.

4. Authorized Purchasers

Orders and deliveries are subject to the qualification/authorization of the purchasing companies or persons (e.g., pharmacies, research institutes, laboratories, etc.).
We do not supply individuals/private persons.

5. Payment Terms

The prices listed in the catalog are indicative and subject to market fluctuations. Prices are in Swiss Francs (CHF) and include VAT. Shipping and packaging costs are borne by the client.

Payments must be made within 30 days from the invoice date. In case of delay, Pharmaserv reserves the right to apply a CHF 20 recovery fee, without sending a reminder notice. Pharmaserv reserves the right to require payment in advance for any order.

6. Delivery Conditions

Goods can only be delivered to authorized companies. Delivery to private individuals is strictly excluded. Products in stock are shipped immediately to the address provided by the client. Otherwise, an order confirmation with the expected delivery date will be sent. Deliveries, including partial shipments, are made at the client’s cost and risk.

7. Retention of Title

Delivered goods remain the property of Pharmaserv until full payment has been received. In case of late or non-payment, Pharmaserv reserves the right to cancel the contract (contract termination declaration) and reclaim the goods.

8. Return Policy

Returns are accepted under the following conditions:
A written return authorization must be obtained beforehand. Returned goods must be in their original packaging, unopened, without any markings, and in perfect resale condition, within 14 days of receipt. Return shipping costs are borne by the client.

If these conditions are not met, Pharmaserv reserves the right to refuse the return. Approved returns will be credited as a credit note issued by Pharmaserv SA.

9. Warranty and Liability

All products listed in the catalog or online are supplied with a certificate of analysis from the manufacturer, matching the client’s specifications. If, for any reason, the product does not meet the specified criteria, it will be replaced or credited.

This warranty becomes void if the goods are modified or misused without Pharmaserv’s written consent. Pharmaserv disclaims any further liability.

10. Intellectual Property

Pharmaserv SA retains all rights over images, texts, and graphics published on its website. Copying or reproducing content from the website is only permitted for placing orders with Pharmaserv SA.

The name PHARMASERV SA, as well as its headers, navigation bars, graphics, and icons, are the exclusive property of the company. Any use or reproduction by clients requires prior written consent from Pharmaserv.

11. Data Protection

Pharmaserv guarantees the protection and confidentiality of personal data, in compliance with the applicable Swiss data protection laws. Personal data is only shared with third parties with the client's explicit consent.

Applicable law and jurisdiction: Contracts concluded under these T&C are subject to Swiss law. The exclusive place of jurisdiction is Stansstad (Nidwalden, Switzerland). However, Pharmaserv SA reserves the right to bring actions before the court at the client’s place of business.

12. General Provisions

For any purchase of goods listed in the catalog or online, only the terms in force at the time of contract conclusion apply, even if they differ from the buyer’s general terms.

If any clause becomes invalid, the legal validity of the remaining clauses remains unaffected. Pharmaserv SA reserves the right to modify these terms and conditions at any time without notice.
